Welcome to Ochuma. These Terms and Conditions ("Terms") govern your access to and use of the Ochuma website, store, and all related content, features, tools, products, and services (collectively, the "Services"). The Services are operated by Ochuma ("Ochuma," "we," "us," or "our") and are hosted on the Shopify platform.


By accessing, browsing, or making a purchase through the Services, you agree to be bound by these Terms and by our Privacy Policy, Shipping Policy, and Return & Refund Policy, which are incorporated here by reference. If you do not agree to these Terms, please do not use the Services.

1. Eligibility

By using the Services, you confirm that you are at least 18 years of age and are capable of entering into a legally binding contract under the Indian Contract Act, 1872. If you are using the Services on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms.

2. Your Account

To access certain features, you may need to create an account. You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. We reserve the right to suspend or terminate your account if any information provided is inaccurate, or if we believe you have violated these Terms.

3. Products, Pricing, and Availability

  • All products are subject to availability, and we may discontinue any product at any time.

  • All prices are listed in Indian Rupees (INR / ₹) and are inclusive of applicable taxes unless stated otherwise.

  • We make reasonable efforts to display product colours, descriptions, and details accurately. However, we cannot guarantee that your device's display will be accurate, and minor variations may occur.

  • We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information (including pricing) at any time without prior notice.

4. Orders and Acceptance

Your submission of an order constitutes an offer to purchase. All orders are subject to acceptance by us, and we reserve the right to refuse or cancel any order at our discretion, including in cases of:


  • Suspected fraudulent or unauthorised transactions;

  • Errors in pricing or product information;

  • Limitations on quantities available for purchase; or

  • Inability to fulfil the order.


If we cancel an order after payment has been made, we will refund the amount paid through the original payment method.

5. Payment

We accept payments through the payment methods displayed at checkout, which may include credit/debit cards, UPI, net banking, wallets, and other options enabled via Shopify Payments or our payment processor. (Confirm payment methods, and whether Cash on Delivery is offered.)


By providing payment information, you represent that you are authorised to use the payment method and authorise us to charge the total order amount, including taxes and shipping charges, to that method.

6. Shipping and Delivery

Shipping timelines, charges, and serviceable regions are described in our Shipping Policy. Delivery timeframes are estimates and are not guaranteed.

7. Returns, Refunds, and Cancellations

Returns, refunds, exchanges, and cancellations are governed by our Return & Refund Policy. Please review it before placing an order.

8. Intellectual Property

All content on the Services — including text, graphics, logos, images, product designs, and the "Ochuma" name and marks — is owned by or licensed to us and is protected under applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any content without our prior written permission.

9. User Content and Reviews

If you submit reviews, comments, images, or other content through the Services, you grant us a non-exclusive, royalty-free, worldwide licence to use, display, and reproduce that content in connection with the Services. You are solely responsible for the content you submit and confirm that it does not violate any third-party rights or applicable law. We reserve the right to remove any content at our discretion.

You agree not to use the Services:

We reserve the right to terminate your access for any violation of these Terms.

The Services may contain links to third-party websites or services that are not owned or controlled by us. We are not responsible for the content, policies, or practices of any third-party sites. Your use of such sites is at your own risk.

12. Disclaimers

The Services and all products are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.


Nothing in these Terms limits or excludes any rights you have as a consumer under the Consumer Protection Act, 2019, or other applicable mandatory law that cannot be excluded.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Ochuma shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising out of or related to your use of the Services. Our total liability for any claim arising out of or relating to these Terms or the Services shall not exceed the amount you paid for the product(s) giving rise to the claim.

14. Indemnification

You agree to indemnify and hold harmless Ochuma, its affiliates, and their respective officers, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable legal fees) arising out of your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

15. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts located in Coimbatore, Tamil Nadu, India.

We will acknowledge receipt of complaints within 48 hours and aim to resolve them within one month of receipt.
